Terms & Conditions for Self-Drive Hire
A. “Lambogenie Limited” will be referred to as “The Owner”.
B. The “Hirer” means the person, Firm or Organisation by or on behalf of whom this Agreement is signed.
C. “Authorised Driver” means the Driver(s) additional to the Hirer.
1. The Hirer will ensure that any authorised driver will comply with all the terms and conditions as set out in this agreement.
2. Any breach of any condition of this agreement on the part of the Hirer that results in damage or loss to the Owner will be compensated for in full to the Owner by the Hirer, from the point of the breach resulting in said loss until such moment as the vehicle has been returned to a road-worthy condition, fit for its purpose.
3. The Owner agrees to rent and the Hirer agrees to take the vehicle described overleaf on the terms and conditions as set out in this agreement.
4. The Hirer will return the vehicle with all tyres, tools, accessories and equipment in the same condition as when received, ordinary wear and tear accepted, to the place and date shown overleaf or earlier as demanded by the Owner.
5. The Hirer is responsible for all damage caused by misuse or negligence and for all tyre repairs or replacements and broken or damaged windows, lights and for any damage to the interior of the vehicle. Smoking is prohibited within the vehicle.
6. Notwithstanding the Owners right to demand payment of the hire charges in full, including Value Added Tax, from the Hirer at anytime, the Hirer must pay the Owner the hire charges including the Value Added Tax in full and in one instalment before the expiry of eleven months beginning with the date of this agreement.
7. The Owner shall provide insurance cover unless agreed otherwise, subject to an excess as stipulated overleaf.
8. The Hirer shall be responsible for all uninsured items such as seats/interior, glass of any description, tyres, malicious damage, the costs of rectifying such shall be charged and payable in full.
9. The Hirer shall immediately report any accident to the Owner involving the vehicle and complete an accident report form, no matter how minor the accident may be. The Hirer or any authorised driver will:
a. Obtain the names and addresses of the other motorist(s) or person(s) involved in the accident and the details of any witnesses.
b. Make no admission of liability.
c. Deliver to the Owner all Summonses, Writs and Documents received.
d. Not aid or abet any claimant but co-operate fully with the Owner and the insurance company of the Owner in the investigation and any Defence of any claim made against the Owner.
10. The Hirer will at the request of the Owner do all required by the Owner and permit his name to be used by the Owner for enforcing any rights or remedies against the parties in connection with the vehicle.
11. Should the Hirer wish to make his own insurance arrangements the Hirer will:
a. Be responsible for all injury and damage to the persons and property of third parties and for all loss of or damage to the vehicle and will indemnify the Owner in respect of any loss.
b. Insure the vehicle and the use thereof against Third Party Fire and Theft and accidental damage risks with an insurer and on a form of policy acceptable to the Owner and to furnish the Owner such proof, as they require.
c. Have this insurance indemnify the owner of the vehicle.
12. The vehicle will not be used whether during or after the termination of the period of hire:
a. For the carriage of passengers or property for hire or reward.
b. To carry a greater number of passengers and/or more baggage than recommended by the manufacturer.
c. Knowingly for any unlawful purpose.
d. For racing, pace making, reliability trials, speed testing or driving tuition.
e. To propel or tow any other vehicle or trailer.
f. In violation of the provision of any act, order or regulation affecting the use, loading or condition of a vehicle or for any illegal purpose.
g. Outside the UK mainland without the express written approval and authorization of the Owner.
h. To accommodate or carry pets. Breach of this condition will result in the Owner to be compensated in full for any losses and damage sustained up until such moment as the vehicle has been returned to a roadworthy condition fit for its purpose.
13. The vehicle may not be driven by any person:
a. Other than the Hirer or Authorised driver.
b. Who is under the age of 25 or over the age of 70.
c. Who has not held a valid driving license for a minimum of one year.
d. Who is under the influence of alcohol or any substance which may impair their ability to drive.
e. Whom the owner, prior to commencement of the hire, has not approved in writing.
14. Until the vehicle is returned to the owner, the Hirer is liable as the keeper of the vehicle for any offences, penalties or fine committed or sustained in respect of the vehicle under any relevant road traffic legislation during the rental period in respect of; any fixed penalty or contravention committed in respect of the vehicle in pursuance of an Order under section 45 and/or 46 of the Road Traffic Regulations Act 1984- Local Authorities Act 1984- and any penalty charged incurred under the Road Traffic Act of 1991.
15. The Hirer is also responsible as the Keeper/Owner of the vehicle for any contravention under the Road Traffic Regulations Act 1984 and Local Authorities Act 1996 (as amended). In each and every case the Hirer must pay the Owner the cost of the charge or traffic offence incurred along with an administration fee of £35.00 plus Value Added Tax.
16. The Owner shall not be liable for loss or damage to any property of the Hirer or any other person, which may have been in or on the vehicle either before or after its return to the owner.
17. The Hirer will immediately inform the Owner of any fault in the vehicle and will not use the vehicle whilst it is in an unroadworthy condition.
18. The Hirer is responsible for theft of the vehicle unless the keys are removed and all doors are locked.
19. The Owner accepts no responsibility for delays and/or consequential losses from breakdown or from any other circumstance.
Terms and Conditions for Chauffeured Hire
Lambogenie Ltd (the company) undertakes to hire vehicles to the client (the hirer) under the following terms and conditions.
Bookings and Deposits
Hires are confirmed when a 50% non-refundable deposit is paid. This may be by cash, cheque, credit or debit card.
The remaining balance is to be paid in full 28 days prior to the hire.
Prices are inclusive of VAT charged at 17.5%.
American Express cards may be subject to a 3% surcharge.
No hidden taxes, fees or extra charges will be payable upon completion of the hire, except where additional waiting time has been incurred.
Cancellations
Written notice must be provided 28 days prior to the event for cancellations.
In the event of a cancellation any deposit paid would be forfeited, however, in exceptional circumstances deposits may be refunded at the discretion of the company.
Company Liability
While the company’s vehicles are fully insured for passenger and third party claims under British law and public liability insurance, no responsibility can be accepted for lost, stolen or damaged items belonging to the hirer.
No responsibility will be accepted by the company for adverse weather, traffic conditions or fuel shortages, which may cause delay or cancellation of a booking, by the company.
In the event of unforeseen delays the company will endeavour to contact the hirer by telephone.
Whilst every effort is made by the company to maintain the roadworthiness of the vehicles, no responsibility can be accepted for breakdown either prior or during the hire, however caused. In the unlikely event that breakdown occurs every effort will be made to provide a comparable vehicle, the costs of which will be met by the company. Alternatively, a full refund to the value of the hire will be given.
Damage and Breakages
The hirer shall be fully responsible and liable for any damage caused both to the interior and exterior of the vehicle by the hirer or any member of their party.
The hirer agrees to be liable for the retail cost of repairs, replacement of missing items and/or valeting charges.
Policies
Smoking, the consumption of food, drinks or drugs is not permitted within the vehicle.
Breakdown Terms & Conditions
Our fleet is serviced and maintained to a very high standard, however, by their very nature sportscars can be a little temperamental at times. The entire fleet is covered by a comprehensive breakdown and recovery service - for self-drive hire vehicles the contact number is on a card given to you at the handover. In the event of a breakdown we suggest you call us first for advice, otherwise call the breakdown service.
For chauffeured hires we will endeavour to supply another vehicle of a comparable nature. We understand that there may be some disappointment which is why we will do our utmost to ensure that you are satisfied.
